<p>---------------------------------------------- <br />ENG - TERMS OF SERVICE <br />----------------------------------------------</p>
<p>These terms and conditions apply to all purchases made at e-shop of Amanita Design, s.r.o. starting from 1 January 2014. <br />These terms and conditions closely define and clarify rights and obligations of a seller, which is the company of Amanita Design, s.r.o., with its registered seat at Vrchlického sad 6, 602 00 Brno, IČO: 27733971, incorporated in the business register, section C, entry 55441, kept by the Regional Court in Brno (hereinafter referred to as a „Seller“) and a buyer (hereinafter referred to as a Customer, a Consumer). <br />All the contractual relations are concluded in accordance with a law of the Czech Republic. If the Consumer is a contractor, the Civil Code conditions (no.89/2012 Coll) and the Consumer Protection Act conditions (no. 634/1992 Coll.) apply to relations not defined by these terms and conditions. If the Consumer is not a contractor, the Civil Code (No. 89/2012 Coll) applies to relations not defined by these terms and conditions.</p>
<p>DEFINITION OF TERMS <br />The Seller is a person, who acts according to their business or other business activity when concluding and performing a contract. <br />The Buyer or just a Consumer is any person, who – outside their business activity or outside the independent exercise of their profession - enters into a contract with an entrepreneur or deals with him in any other way. <br />A Buyer, who is not a Consumer, is an entrepreneur. An entrepreneur is also considered to be any person, who enters into contracts related to their own business, producing or similar activity, or in the exercise of their own profession, or a person acting for or on behalf of the entrepreneur.</p>
<p>PURCHASE CONTRACT <br />If the Buyer is a Consumer, the proposal to conclude a purchase contract (the offer) is formed by displaying the goods offered on the website by a supplier; purchase contract is sending an order by the Buyer – Consumer and accepting the order by the supplier. The supplier immediately confirms this accepting to the Buyer by sending an informative e-mail to specified e-mail; this confirmation, however, has no effect on formation of the contract. The newly formed contract (including the agreed price) can be changed or canceled only by agreement of the contractors or based on legal grounds. <br />Before sending the order to the Seller, the Buyer is allowed to check and modify the data inserted in the order, even considering a possibility for a buyer to find and correct mistakes made while inserting data into the order. The order is sent by the Buyer to the Seller by clicking a button „Send an order“. <br />If the Buyer is not a Consumer, the proposal to conclude a purchase agreement is represented by the order of goods sent by the Buyer. The actual purchase contract is concluded at a moment of delivery of a binding agreement with the proposal from the Seller to the Buyer. <br />By concluding the purchase contract the Buyer hereby confirms that he is familiar with these terms and conditions, including the claims procedure, and agrees with them. The Buyer is given sufficient notice about these terms and conditions and the claims procedure prior to placing the order and has the opportunity to become acquainted with them. <br />Time period for settlement of claims is suspended in case the Seller did not receive all the documents necessary for settlement of the claim (parts of goods, or other documents etc.). The Seller is obliged to request additional documentation from the Buyer in the shortest possible time period. The time period is suspended until the Buyer delivers the requested documents. <br />The Seller, inter alia, reserves the right to cancel the order or its part before concluding a purchase contract, based on agreement with a Buyer, in the following cases: goods is not produced or shipped anymore, the supplier changed significantly the price of the goods. In case the Buyer has paid a part or the whole amount of purchase price, this amount will be credited back to his account, unless otherwise agreed by the Seller and the Buyer; in such case the purchase contract is not concluded. <br />The Consumer cannot claim any rights on gifts, that are provided completely free of charge. Such goods meet the conditions of a donation agreement under applicable legislation of the Czech Republic.</p>
<p>RIGHTS FROM FAULTY PERFORMANCE <br />Rights and obligations of the contracting parties regarding the rights of faulty performance shall be governed by the relevant legislation (including the provisions of § 1914-1925, § 2099-2117 and § 2161-2174 of the Act no. 89/2012 Coll., of The Civil Code). <br />The Seller is liable to the Consumer, that the product has no defects when delivered. In particular the Seller is liable to the Consumer, that, when received by the Consumer, <br />- the product has qualities that have been agreed by both contracting parties; and, if there is no such agreement, it has qualities that the Seller or producer described or that were expected by the Buyer based on advertisement made by Seller or manufacturer, <br />- the product fits a purpose given to it by the Seller or a purpose for which this kind of product is usually used, the product corresponds with the quality or construction of the agreed sample or model, if the quality or construction were specified based on sample or model, the product is in corresponding quantity, measure or weight and <br />- the product complies with the legal requirements. <br />If the product does not have the above mentioned qualities, the Consumer may require the supply of a new product without defects, unless it is disproportionate to the character of the defect; but if the defect relates only to a part of the object, the Consumer may only require replacement of parts; if this is not possible, he may withdraw from the contract. If, however, this is disproportionate considering the nature of the defect, especially if the defect can be fixed without undue delay, the Consumer is entitled to a correction of the defect free of charge. The Consumer is entitled to delivery of a new product, or replacement of its parts, when the defect is removable – in case the product cannot be properly used for recurring defect or a greater number of defects. In this case, the Consumer has the right to withdraw from the contract. <br />If the Consumer does not withdraw from the contract or if he does not assert the right to receive a new product without defects, to replace its part or to get it fixed, he may request reasonable discount. The Consumer has a right for a reasonable discount also in case the Seller is not able to deliver a new product without defects, replace its part or fix it, and also in case the Seller fails to rectify the situation in reasonable time or in case the rectification would cause substantial difficulties to the Consumer. <br />The right from the faulty performance is not applicable if the Buyer knew that the object was defected prior to its receiving or if the defect was caused by the Buyer himself. <br />The Consumer is entitled to exert the right from defect, which occurs in consumer goods within 24 months from the delivery. If the defect appears within 6 months after the delivery, the product is considered to be defected already upon delivery. <br />Other rights and obligations of contracting parties related to the Seller´s liability for defects may be modified by claims procedure of the Seller.</p>
<p>RIGHT OF THE CONSUMER TO WITHDRAW FROM THE CONTRACT <br />If the purchase contract is concluded by means of long-distance communication systems (e-shop), the Consumer has the right, in accordance with paragraph § 1829. 1 of the Civil Code, to withdraw from the contract within 14 days after delivery of the goods without giving a reason (if various kinds of goods or delivery of few parts is subject of the contract, the time period runs from the date of the delivery of the last package of goods). Withdrawal from the contract must be sent to the Seller in time period specified in previous sentence. <br />In case the Consumer wants to withdraw from the contract in the 14-day period as stated in the previous paragraph, he contacts the Seller and, preferably in writing, states that he withdraws from the contract and ideally adds the order number and date of purchase. <br />Withdrawal from the purchase contract can also be sent to the Seller´s place of business address or Seller´s e-mail address merch@amanita.design.net. <br />In case the Buyer withdraws from contract as stated in the previous paragraphs, the Seller will return the funds received from the Buyer (except for the amount representing the additional costs of delivering the goods resulting from the Buyer´s choice of delivery method, which is different from the least expensive type of standard delivery of the goods offered by the Seller) in 14 days from withdrawing from contract by the Buyer. The refund is made in the same way in which the Seller accepted the money from the Buyer if not stated otherwise by the Buyer. The Seller is also entitled to return the fulfilment provided by the Buyer on return of the goods by the Buyer or otherwise, if the Buyer agrees and if it does not cause additional costs to the Buyer. If the Buyer withdraws from the contract, the Seller is not obliged to refund received money to the Buyer before the Buyer returns the goods or proves, that the goods were sent to the Seller. <br />The provisions of the law on withdrawal within 14 days, however, cannot be seen as free rental of goods. The Consumer, if using the rights to withdraw from the contract in 14-day period, is obliged to return everything he received based on the purchase contract back to the Seller in 14 days after the withdrawal from the contract. If this is not possible anymore (e.g. the goods are destroyed or consumed in the meantime), the Consumer must provide monetary compensation in return . If the returned goods is only partially damaged, the Seller may apply the right to compensation to the Consumer and add a right for refund of the purchase price. In such case the Seller is obliged to prove the damage done on goods. In such case only reduced purchase price is refunded by the Seller to the Buyer. <br />The seller can add their own real expenses related to the return of the goods to the purchase price which is supposed to be refunded to the Buyer. <br />The Consumer has no right of withdrawal from the contract in accordance with § 1837 of the Civil Code particularly in case of following contracts: <br />- service contract, if the services were provided to the Consumer, with his prior explicit consent, before the deadline for withdrawal from the contract and the entrepreneur told the Consumer before entering into the contract, that in such case the Consumer has no right for withdrawal, <br />- contract on delivery of the goods that were adjusted according to Consumer’s request of for Consumer himself <br />- contract on delivery of the goods in closed packaging, that were taken out from the packaging by the Consumer and thus cannot be returned due to hygienic reasons <br />- contract on delivery of audio or video recording or computer program, if the Consumer broke its original packaging <br />Further information about the Consumer´s withdrawal from the contract in 14-day period are available on the website of the Seller merch.amanita-design.net.</p>
<p>The Seller reserves the right to cancel the order of goods marked as „Currently unavailable“ in case, the product is no longer available or cannot by replaced with any other model or if the price has changed dramatically and the Customer doesn’t accept this before entering into the purchase contract. The seller informs the Customer about such situation. If part or the whole order is paid, the money will be refunded to the Customer’s account, unless the Seller and the Buyer agree otherwise.</p>
<p>PRIVACY POLICY <br />The Seller issued Privacy Policy for its customers. It is available on website: merch.amanita-design.net.</p>
<p>COSTS FOR USING LONG-DISTANCE COMMUNICATION SYSTEMS <br />The Buyer agrees to use long-distance communication systems when concluding the purchase contract. The costs incurred by the Buyer by using the long-distance communication systems in connection with concluding the purchase contract (costs of internet connection, telephone costs) are paid by the Buyer.</p>
<p>FINAL PROVISIONS <br />Settling of Consumers´ complaints is provided by the Seller via e-mail address merch@amanita-design.net. Information about settling of the complaint is sent by the Seller to Consumer’s e-mail address. <br />The seller is entitled to sell goods based on a trade license. The trade inspection is carried out by the appropriate authority of Trade Licensing Office. The supervision of privacy policy is provided by the Office for Personal Data Protection. The Czech Trade Inspection Authority, inter alia, in a defined scope, performs the supervision of observance of the Law no. 634/19 Coll. on Consumer Protection, as stated in later amendments. <br />These terms and conditions apply as stated on a website of the Seller as of the date of conclusion of a contract. The order made by a Consumer is –after its confirmation as a contract between the Buyer and the Seller - archived for the purpose of its completing and other evidence and its state is available to the Buyer. The contract may be concluded in the Czech language, or also in other languages, provided it is not a reason for impossibility to conclude the contract. <br />These terms and conditions enable the Consumer to their archiving and reproduction. <br />According to the law on the registration of sales, the seller is obliged to issue a receipt to the buyer. He is also obliged to register a revenue received from the Tax online; in case of technical failure, then within 48 hours. <br />At the moment of concluding a purchase contract the Buyer accepts all the provisions of the terms and conditions in force as of the date of dispatching the order, including the price of the ordered goods specified in the confirmed order, unless in a particular case it was agreed otherwise. <br />If the buyer is not a consumer, any dispute which may arise from this purchase contract and in connection to it shall be arbitrated, with final validity, according to material and procedural law of the Czech Republic, at the Arbitration Court attached to the Economic Chamber of the Czech Republic and Agricultural Chamber of the Czech Republic in Prague, in accordance with its code, by one arbitrator appointed by the president of the Arbitration Court. The working language will be English.</p>
<p>These terms and conditions become effective on May 25th 2018.</p>

<p>Tyto obchodní podmínky platí pro nákup v internetovém obchodě společnosti Amanita Design, s.r.o. od 1.1. 2014. <br />Podmínky blíže vymezují a upřesňují práva a povinnosti prodávajícího, kterým je společnost Amanita Design, s.r.o., se sídlem Vrchlického sad 6, 602 00 Brno, IČO: 27733971, zapsané v obchodním rejstříku v oddíle C, vložka 55441 vedená u Krajského soudu v Brně (dále jen “prodávající”) a kupujícího (zákazník, spotřebitel). <br />Veškeré smluvní vztahy jsou uzavřeny v souladu s právním řádem České republiky. Je-li smluvní stranou spotřebitel, řídí se vztahy neupravené obchodními podmínkami občanským zákoníkem (č. 89/2012 Sb.) a zákonem o ochraně spotřebitele (č. 634/1992 Sb.). Je-li smluvní stranou nikoli spotřebitel, řídí se vztahy neupravené obchodními podmínkami občanským zákoníkem (č. 89/2012 Sb.).</p>
<p>VYMEZENÍ POJMŮ <br />Prodávající je osoba, která při uzavírání a plnění smlouvy jedná v rámci své obchodní nebo jiné podnikatelské činnosti. <br />Kupující spotřebitel nebo jen spotřebitel je každý člověk, který mimo rámec své podnikatelské činnosti nebo mimo rámec samostatného výkonu svého povolání uzavírá smlouvu s podnikatelem nebo s ním jinak jedná. <br />Kupující, který není spotřebitel, je podnikatel. Za podnikatele se považuje také každá osoba, která uzavírá smlouvy související s vlastní obchodní, výrobní nebo obdobnou činností či při samostatném výkonu svého povolání, popřípadě osoba, která jedná jménem nebo na účet podnikatele</p>
<p>KUPNÍ SMLOUVA <br />Je-li kupujícím spotřebitel, návrhem k uzavření kupní smlouvy (nabídkou) je umístění nabízeného zboží dodavatelem na stránky, kupní smlouva vzniká odesláním objednávky kupujícím–spotřebitelem a přijetím objednávky dodavatelem. Toto přijetí dodavatel neprodleně potvrdí kupujícímu informativním e-mailem na zadaný e-mail, na vznik smlouvy však toto potvrzení nemá vliv. Vzniklou smlouvu (včetně dohodnuté ceny) lze měnit nebo rušit pouze na základě dohody stran nebo na základě zákonných důvodů. <br />Před zasláním objednávky prodávajícímu je kupujícímu umožněno zkontrolovat a měnit údaje, které do objednávky kupující vložil, a to i s ohledem na možnost kupujícího zjišťovat a opravovat chyby vzniklé při zadávání dat do objednávky. Objednávku odešle kupující prodávajícímu kliknutím na tlačítko „Odeslat objednávku“. <br />Není-li kupujícím spotřebitel, návrhem na uzavření kupní smlouvy je odeslaná objednávka zboží kupujícím a samotná kupní smlouva je uzavřena momentem doručení závazného souhlasu prodávajícího kupujícímu s tímto jeho návrhem. <br />Uzavřením kupní smlouvy kupující stvrzuje, že se seznámil s těmito obchodními podmínkami, včetně reklamačního řádu, a že s nimi souhlasí. Na tyto obchodní podmínky a reklamační řád je kupující dostatečným způsobem před vlastním uskutečněním objednávky upozorněn a má možnost se s nimi seznámit. <br />Běh lhůty pro vyřízení reklamací je pozastaven v případě, že prodávající neobdržel veškeré podklady potřebné pro vyřízení reklamace (části zboží, jiných podkladů apod.). Prodávající je povinen si vyžádat doplnění podkladů od kupujícího v nejkratší možné době. Lhůta je od tohoto data pozastavena až do dodání vyžádaných podkladů kupujícím. <br />Prodávající si mimo jiné vyhrazuje právo zrušit objednávku nebo její část před uzavřením kupní smlouvy, na základě dohody s kupujícím, v těchto případech: zboží se již nevyrábí nebo nedodává nebo se výrazným způsobem změnila cena dodavatele zboží. V případě, že Kupující zaplatil již část nebo celou částku kupní ceny, bude mu tato částka převedena zpět na jeho účet, ledaže se prodávající a kupující dohodnou jinak;k uzavření Kupní smlouvy nedojde. <br />Na dárky, které jsou poskytovány zcela zdarma, nelze uplatňovat jakákoliv práva spotřebitele. Takové zboží splňuje podmínky Darovací smlouvy a veškeré normy dle platné legislativy ČR.</p>
<p>PRÁVA Z VADNÉHO PLNĚNÍ <br />Práva a povinnosti smluvních stran ohledně práv z vadného plnění se řídí příslušnými obecně závaznými předpisy (zejména ustanoveními § 1914 až 1925, § 2099 až 2117 a § 2161 až 2174 zákona č. 89/2012 Sb., občanského zákoníku). <br />Prodávající odpovídá spotřebiteli, že věc při převzetí nemá vady. Zejména prodávající odpovídá spotřebiteli, že v době, kdy spotřebitel věc převzal, <br />- má věc vlastnosti, které si strany ujednaly, a chybí-li ujednání, takové vlastnosti, které prodávající nebo výrobce popsal nebo které kupující očekával s ohledem na povahu zboží a na základě reklamy jimi prováděné, <br />- se věc hodí k účelu, který pro její použití prodávající uvádí nebo ke kterému se věc tohoto druhu obvykle používá, <br />- věc odpovídá jakostí nebo provedením smluvenému vzorku nebo předloze, byla-li jakost nebo provedení určeno podle smluveného vzorku nebo předlohy, <br />- je věc v odpovídajícím množství, míře nebo hmotnosti a <br />- věc vyhovuje požadavkům právních předpisů. <br />Nemá-li věc výše uvedené vlastnosti, může spotřebitel požadovat i dodání nové věci bez vad, pokud to není vzhledem k povaze vady nepřiměřené, ale pokud se vada týká pouze součásti věci, může spotřebitel požadovat jen výměnu součásti; není-li to možné, může odstoupit od smlouvy. Je-li to však vzhledem k povaze vady neúměrné, zejména lze-li vadu odstranit bez zbytečného odkladu, má spotřebitel právo na bezplatné odstranění vady. Právo na dodání nové věci, nebo výměnu součásti má spotřebitel i v případě odstranitelné vady, pokud nemůže věc řádně užívat pro opakovaný výskyt vady po opravě nebo pro větší počet vad. V takovém případě má spotřebitel i právo od smlouvy odstoupit. <br />Neodstoupí-li spotřebitel od smlouvy nebo neuplatní-li právo na dodání nové věci bez vad, na výměnu její součásti nebo na opravu věci, může požadovat přiměřenou slevu. Spotřebitel má právo na přiměřenou slevu i v případě, že mu prodávající nemůže dodat novou věc bez vad, vyměnit její součást nebo věc opravit, jakož i v případě, že prodávající nezjedná nápravu v přiměřené době nebo že by zjednání nápravy spotřebiteli působilo značné obtíže. <br />Právo z vadného plnění kupujícímu nenáleží, pokud kupující před převzetím věci věděl, že věc má vadu, anebo pokud kupující vadu sám způsobil. <br />Spotřebitel je oprávněn uplatnit právo z vady, která se vyskytne u spotřebního zboží v době dvaceti čtyř měsíců od převzetí. Projeví-li se vada v průběhu šesti měsíců od převzetí, má se za to, že věc byla vadná již při převzetí. <br />Další práva a povinnosti stran související s odpovědností prodávajícího za vady může upravit reklamační řád prodávajícího.</p>
<p>PRÁVO SPOTŘEBITELE ODSTOUPIT OD SMLOUVY <br />Pokud je kupní smlouva uzavřena pomocí prostředků komunikace na dálku (v internetovém obchodě), má spotřebitel v souladu s § 1829 odst. 1 občanského zákoníku právo bez udání důvodu odstoupit od smlouvy do 14 dní od převzetí zboží (v případě, že předmětem kupní smlouvy je několik druhů zboží nebo dodání několika částí, běží tato lhůta ode dne převzetí poslední dodávky zboží). Odstoupení od kupní smlouvy musí být prodávajícímu odesláno ve lhůtě uvedené v předchozí větě. <br />V případě, že si spotřebitel přeje dle předchozího odstavce odstoupit od smlouvy ve lhůtě 14 dnů, kontaktuje prodávajícího a nejlépe písemně uvede, že odstupuje od smlouvy ideálně s uvedením čísla objednávky a data nákupu <br />Odstoupení od kupní smlouvy může spotřebitel zasílat mimo jiné na adresu provozovny prodávajícího či na adresu elektronické pošty prodávajícího merch@amanita.design.net. <br />V případě, že kupující dle předchozích odstavců odstoupí od smlouvy, vrátí prodávající peněžní prostředky přijaté od kupujícího (kromě částky představující dodatečné náklady na dodání zboží vzniklé v důsledku kupující zvoleného způsobu dodání zboží, který je jiný než nejlevnější způsob standardního dodání zboží nabízený prodávajícím) do 14 dnů od odstoupení od kupní smlouvy kupujícím, a to stejným způsobem, jakým je prodávající od kupujícího přijal, pokud kupující neurčí jinak. Prodávající je taktéž oprávněn vrátit plnění poskytnuté kupujícím již při vrácení zboží kupujícím či jiným způsobem, pokud s tím kupující bude souhlasit a nevzniknou tím kupujícímu další náklady. Odstoupí-li kupující od kupní smlouvy, prodávající není povinen vrátit přijaté peněžní prostředky kupujícímu dříve, než mu kupující zboží vrátí nebo prokáže, že zboží prodávajícímu odeslal. <br />Ustanovení zákona o odstoupení od smlouvy ve lhůtě 14 dnů však nelze chápat jako možnost bezplatného zapůjčení zboží. Spotřebitel v případě využití práva na odstoupení od smlouvy do 14 dní od převzetí plnění, musí prodávajícímu do 14 dnů od odstoupení od smlouvy vydat vše, co na základě kupní smlouvy získal. Pokud to již není dobře možné (např. v mezidobí bylo zboží zničeno nebo spotřebováno), musí spotřebitel poskytnout peněžitou náhradu jako protihodnotu toho, co již nemůže být vydáno. Pokud je vrácené zboží poškozeno jen částečně, může prodávající uplatnit na spotřebiteli právo na náhradu škody a započíst svůj nárok na vrácenou kupní cenu. Prodávající je v takovém případě povinen vzniklou škodu prokázat. Prodávající spotřebiteli v takovém případě vrací jen takto sníženou kupní cenu. <br />Na kupní cenu, která má být kupujícímu vrácena, může prodávající započíst své skutečně vynaložené náklady spojené s vrácením zboží. <br />Právo na odstoupení od smlouvy spotřebitel v souladu s ustanovením § 1837 občanského zákoníku nemá zejména, v případě smluv: <br />- o poskytování služeb, jestliže byly splněny s jeho předchozím výslovným souhlasem před uplynutím lhůty pro odstoupení od smlouvy a podnikatel před uzavřením smlouvy sdělil spotřebiteli, že v takovém případě nemá právo na odstoupení od smlouvy, <br />- o dodávce zboží, které bylo upraveno podle přání spotřebitele nebo pro jeho osobu, <br />- o dodávce zboží v uzavřeném obalu, které spotřebitel z obalu vyňal a z hygienických důvodů jej není možné vrátit, <br />- o dodávce zvukové nebo obrazové nahrávky nebo počítačového programu, pokud porušil jejich původní obal, <br />Další informace k odstoupení spotřebitele ve 14 denní lhůtě jsou k dispozici na internetových stránkách prodávajícího merch.amanita-design.net. <br />Prodávající si vyhrazuje právo na zrušení objednávky u zboží označeného pojmem „Momentálně nedostupné“ v případě, že zboží již není možné dodat ani nahradit jiným modelem nebo pokud se jeho cena výrazně změnila a zákazník toto před samotným vznikem kupní smlouvy neakceptuje. Prodávající zákazníka o této situaci informuje. Byla-li část nebo celá objednávka uhrazena, budou zákazníkovi peníze vráceny na účet, ledaže se prodávající a kupující dohodnou jinak.</p>
<p>OCHRANA OSOBNÍCH ÚDAJŮ <br />Prodávající vydal Zásady ochrany osobních údajů. Ty jsou dostupné na webové stránce: merch.amanita-design.net.</p>
<p>NÁKLADY NA POUŽITÍ KOMUNIKAČNÍCH PROSTŘEDKŮ NA DÁLKU <br />Kupující souhlasí s použitím komunikačních prostředků na dálku při uzavírání kupní smlouvy. Náklady vzniklé kupujícímu při použití komunikačních prostředků na dálku v souvislosti s uzavřením kupní smlouvy (náklady na internetové připojení, náklady na telefonní hovory) si hradí kupující sám.</p>
<p>ZÁVĚREČNÁ USTANOVENÍ <br />Vyřizování stížností spotřebitelů zajišťuje prodávající prostřednictvím elektronické adresy merch@amanita-design.net. Informaci o vyřízení stížnosti kupujícího zašle prodávající na elektronickou adresu kupujícího. <br />Prodávající je oprávněn k prodeji zboží na základě živnostenského oprávnění. Živnostenskou kontrolu provádí v rámci své působnosti příslušný živnostenský úřad. Dozor nad oblastí ochrany osobních údajů vykonává Úřad pro ochranu osobních údajů. Česká obchodní inspekce vykonává ve vymezeném rozsahu mimo jiné dozor nad dodržováním zákona č. 634/1992 Sb., o ochraně spotřebitele, ve znění pozdějších předpisů. <br />Tyto obchodní podmínky platí ve znění uvedeném na internetových stránkách prodávajícího, v den uzavření kupní smlouvy. Objednávka spotřebitele je po svém potvrzením jako uzavřená smlouva mezi kupujícím a prodávajícím archivována za účelem jejího splnění a další evidence a její stav je přístupný kupujícímu. Smlouvu lze uzavřít v českém jazyce, případně i v jiných jazycích, pokud to nebude důvodem nemožnosti jejího uzavření. <br />Tyto obchodní podmínky spotřebiteli umožňují jejich archivaci a reprodukci. Podle zákona o evidenci tržeb je prodávající povinen vystavit kupujícímu účtenku. Zároveň je povinen zaevidovat přijatou tržbu u správce daně online; v případě technického výpadku pak nejpozději do 48 hodin. <br />Momentem uzavření kupní smlouvy kupující přijímá veškerá ustanovení obchodních podmínek ve znění platném v den odeslání objednávky včetně ceny objednaného zboží uvedenou v potvrzené objednávce, nebylo-li v konkrétním případě prokazatelně dohodnuto jinak. <br />Není-li kupující spotřebitelem, veškeré spory vznikající z této kupní smlouvy a v souvislosti s ní budou rozhodovány s konečnou platností podle hmotného a procesního práva České republiky u Rozhodčího soudu při Hospodářské komoře České republiky a Agrární komoře České republiky v Praze podle jeho řádu jedním rozhodcem jmenovaným předsedou Rozhodčího soudu. Jednacím jazykem bude anglický jazyk."</p>
